Terms of Service
These terms apply,KAIAN Inc. (hereinafter "the Company") to users (hereinafter "Users") of the official website (kaian.jp, hereinafter "this Site") and AI Skin Diagnosis service (including EVOLURE AI Skin Diagnosis, collectively "the Service") operated by the Company. Users are deemed to have agreed to these terms upon using the Service.
Provisions regarding product sales on the planned EC site (evolure.jp, scheduled for July 2026) will be separately defined at site launch and added to these terms.
Article 1. Scope of Application
These terms apply to all matters related to the use of the Service provided by the Company. The Service does not currently include product sales. If product sales begin in the future, notations under the Act on Specified Commercial Transactions will be separately posted and applied alongside these terms.
Article 2. Changes to Terms
The Company may change these terms without prior notice or consent. Changes take effect upon posting on this Site, and the latest version applies thereafter.
Article 3. Suspension/Interruption of the Service
The Company may interrupt or suspend the Service for maintenance, system operation, or other reasons without prior notice. The Company bears no responsibility for any disadvantage or damage from such interruptions.
Article 4. Handling of Personal Information
The Company handles users' personal information appropriately based on the separately defined "Privacy Policy".
- Acquisition: Acquired through appropriate and fair means.
- Purpose of Use: Used for customer support, information delivery, service quality improvement, marketing analysis, and fraud prevention.
- Safety Management: Implementing organizational, personnel, physical, and technical security measures to prevent leaks and damage.
- Third-Party Provision & Outsourcing: Not provided to third parties without consent, except as required by law or to contractors under NDA.
Article 5. Prohibited Acts
Users shall not engage in the following:
- Submission of false information, or misuse of another person's personal information
- Acts violating the Company's terms and abusive use
- Unauthorized upload of another person's facial photo to the AI Skin Diagnosis service
- Improper use of our services with automation tools, bots, etc.
- Reproducing, reposting, or redistributing content on this Site (ingredient dictionary, skincare guide, etc.) without the Company's written permission
- Other acts deemed inappropriate by the Company
Article 6. Intellectual Property
Copyright and other intellectual property rights to information on this Site (text, images, logos, ingredient database, etc.) belong to the Company or rightful owners. Use beyond personal scope requires prior written permission.
Article 7. Disclosure, Correction, and Suspension of Use
Users who wish to request disclosure, correction, deletion, or suspension of their personal information should contact us; we will respond promptly after identity confirmation. See Contact Information in Section 8.
Article 8. Disclaimer
The Company is responsible for direct and ordinary damages only when caused by intentional acts or negligence (excluding gross negligence). The Company bears no responsibility for delays caused by force majeure such as natural disasters. While reasonable care is taken regarding the accuracy and completeness of information on this Site, no guarantee is provided.
Article 9. AI Skin Diagnosis Service
- The AI Skin Diagnosis Service (including EVOLURE AI Skin Diagnosis) is free to use (no membership required).
- AI Skin Diagnosis results (record, recommended formulation) are reference information only, not medical diagnosis or prescription. The Company makes no warranty regarding the accuracy or completeness of diagnostic results.
- Photos taken for diagnosis are not stored on our servers after processing.Processing is performed in volatile memory and discarded immediately after result generation.
- Skin diagnosis result data (text information such as scores and recommended formulations) is used only for purposes defined in the Privacy Policy.
- The AI Skin Diagnosis Service may be modified or suspended without prior notice for maintenance or improvement.
- This Service is not a medical device. For final judgments about skin condition, please consult a licensed medical professional.
Article 10. Governing Law & Jurisdiction
These terms are interpreted under Japanese law. The Tokyo District Court has exclusive jurisdiction as the court of first instance for any disputes.
